Quick Summary: By using HeyVite, you agree to follow these rules. All paid upgrades (a one-time charge per event, not a subscription) are securely processed by our Merchant of Record, Paddle. You retain full ownership of your event data, but you must ensure you have legal consent to message your guest lists and that your events adhere to our ethical standards (no spam, no profanity, no fraudulent content).

1. Agreement to Terms

Welcome to HeyVite. These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you", "user", "host"), and HeyVite ("HeyVite", "we", "us", "our"), concerning your access to and use of the HeyVite website, invitation builder, host dashboard, and guest RSVP portals.

By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are prohibited from using the platform and must discontinue use immediately.

2. Merchant of Record and Paid Services

HeyVite offers free standard invitations as well as one-time paid upgrades for a single event, sold by guest-list size. Every design and website feature (the full Card Studio, the premium and luxe collections, the wedding website and a yourname.heyvite.com address) is included free on every plan; a paid upgrade only raises the guest limit for that event. Paid upgrades are a single charge per event, not a recurring subscription.

Merchant of Record: Our order process is conducted and securely facilitated by our Merchant of Record, Paddle.com Market Limited ("Paddle"). Paddle is the legal vendor and merchant of record for all purchases made on the HeyVite platform.

Paddle is responsible for processing credit cards, digital wallets, collecting local sales taxes (VAT, GST, and state sales taxes), and handling payment inquiries. By executing a checkout upgrade on HeyVite, you agree to be bound by Paddle's terms and conditions in addition to these Terms. All transactions appear on your card statement as PADDLE.NET * HEYVITE.

Refunds: Refunds for paid upgrades are governed by our Refund Policy: a full refund within 14 days of purchase, provided no invitations have been sent for the event. After that window, the purchase is final except where a refund is required by applicable law.

3. User Registration and Account Security

To build, publish, and track event invitations, you must register an account. You agree to provide accurate, current, and complete information during registration and to keep this info updated.

You are entirely responsible for maintaining the confidentiality of your credentials (including passkeys and passwords) and for any activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access or any security breach.

4. Acceptable Use and Platform Rules

HeyVite is a premium, family-friendly RSVP and invitation provider. To maintain platform safety, you explicitly agree not to use the services to:

  • Send Unsolicited Messages (Spam): You must only invite guests who have given you explicit consent to contact them. Automated bulk messaging of scraped phone numbers or purchased email lists is strictly prohibited.
  • Inappropriate Language and Profanity: You must not upload text, event details, or images containing severe profanity, hate speech, threats, harassment, or explicit/pornographic content. HeyVite reserves the right to run automated profanity filters to block offensive material before delivery.
  • Fraud and Phishing: You must not create invitations intended to deceive guests, impersonate other individuals or entities, or extract sensitive financial details (e.g. asking guests for bank codes or passwords).
  • System Abuse: You must not attempt to reverse engineer, bypass security keys, scrape guest list endpoints, or inject malicious code (SQL/XSS injections) into our text input panels.

5. Intellectual Property Rights

Our Proprietary Property: Unless otherwise indicated, the website and services, including all source code, database structures, UI templates, design configurations, layout components, artwork, color schemes, and vector icons ("HeyVite Content") are the exclusive intellectual property of HeyVite.

We grant you a limited, non-exclusive, non-transferable, revocable license to access our editor tools and display completed invitation templates strictly to your invitees for your own designated event. You may not resell, white-label, or package our template designs for commercial layout services without explicit written consent.

Your Provided Content: You retain all intellectual property rights to the text, custom event descriptions, and photographs you upload to your invitations. By uploading content, you grant HeyVite a royalty-free, worldwide license to host, parse, cache, and transmit this content strictly to deliver the service to your guests.

6. Term and Account Termination

These Terms remain in full force while you use our services. We reserve the absolute right, without notice or liability, to suspend, terminate, or restrict your account and delete your invitation records if we believe you are in breach of these Terms, have engaged in fraudulent activity, or are causing harm to other hosts or guests.

If your account is terminated for violating acceptable use policies, any paid upgrade is forfeited and refunds will not be issued.

7. Limitation of Liability and Warranties

HeyVite is provided on an "AS-IS" and "AS-AVAILABLE" basis. You agree that your use of our services is at your own risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

HeyVite, its directors, employees, or agents shall not be liable to you or any third party for any direct, indirect, incidental, special, or consequential damages (including lost profits, lost guest RSVPs, or event planning cancellations) arising from platform downtime, email delivery delays, or third-party processor disruptions. Our maximum cumulative liability for any claim shall not exceed the amount paid by you to HeyVite in the three (3) months preceding the incident.

8. Governing Law and Disputes

These Terms and your use of the platform are governed by and construed in accordance with the laws of the Sultanate of Oman, without regard to its conflict of law principles. Any legal action or dispute arising out of these Terms shall be resolved exclusively in the courts of Oman, and you consent to personal jurisdiction in such courts.
